Reclamación fue presentada por un sindicato de pescadores, buzos y recolectores del sector de Chungungo, en la comuna de La Higuera en contra del proceso realizado por el Ministerio del Medio Ambiente.
El Primer Tribunal Ambiental de Antofagasta (1TA) desestimó la reclamación presentada por el Sindicato de Trabajadores Independientes de Buzos Ayudantes, Pescadores y Recolectores de la Caleta Chungungo contra el Ministerio del Medio Ambiente, confirmando la legalidad del Decreto Supremo N° 33/2023, que declara el Santuario de la Naturaleza Cruz Grande en la comuna de La Higuera.
El Tribunal concluyó que el proceso administrativo y la gestión para la declaratoria de la zona de protección se ajustaron a la normativa vigente en ese momento. “El hecho de que la toma de razón de dicho decreto ocurriera después de la entrada en vigor de la Ley N° 21.600 -que crea el Sistema de Biodiversidad de Áreas Protegidas- no afecta su validez, ya que dicho trámite solo determina su eficacia, no su existencia”, indicó.
Asimismo, se descartó la presunta superposición entre los polígonos del Santuario y el Área de Manejo de Recursos Bentónicos (AMERB) “Temblador”. Esta última afirmación fue calificada como un error cartográfico sin relevancia jurídica para anular el acto administrativo.
Según la sentencia, “la tramitación del procedimiento y la dictación del acto final con el D.S. N° 33/2023 constituyen situaciones jurídicas consolidadas que no se ven alteradas por la entrada en vigor de la Ley N° 21.600, sin que resulte posible aplicar retroactivamente sus disposiciones, cuestión que esta proscrita en nuestro ordenamiento”.
La decisión contó con el voto en contra de la Ministra Sandra Álvarez Torres, quien consideró que debía acogerse la reclamación debido a que se habría configurado en la especie una disociación entre existencia y eficacia del acto jurídico impugnado, además de una efectiva superposición entre los polígonos del santuario y la AMERB “Temblador”.
El Santuario, con una extensión de 486,8 hectáreas, protege un ecosistema terrestre de gran valor ecológico. Incluye especies como el lucumillo, diversas cactáceas endémicas y una rica herpetofauna. El Consejo de Monumentos Nacionales (CMN) destacó en su informe técnico que el área “cumple con las condiciones descritas en el artículo 31 de la Ley N° 17.288, considerando su valor ambiental y su potencial para investigaciones científicas”.
